1. Acceptance and Authority

These Employer Terms of Use apply when your company registers an employer account on ProJob, posts an opportunity, receives applications, or accesses candidate data through ProJob. ProJob is operated by [[LEGAL_ENTITY_NAME]], registered at [[REGISTERED_ADDRESS]].

By registering or by using an employer account, you confirm that you are authorised to accept these terms on behalf of your company, and that your company will be bound by them.

Where your company has signed a separate written agreement with ProJob, that agreement takes precedence over these terms wherever the two differ.

2. Employer Accounts

An employer account belongs to the company, not to the individual who created it. If that person leaves, the company keeps the account.

You are responsible for everyone who uses your account, including colleagues you invite. Keep credentials secure and tell us promptly if you believe an account has been compromised.

ProJob may ask you to verify your company before certain features are enabled. We may decline or withdraw verification.

3. What You May Post

Every listing must be a genuine, currently open opportunity at the company named in the listing.

Listings must state accurately: the role, the location or work mode, the employment type, and the compensation or stipend where stated. If a detail is not yet decided, leave it out rather than state something that is not true.

You may not post:

  • An opportunity that does not exist, or is no longer open, to collect resumes
  • An opportunity at a company other than the one named, without that company's authorisation
  • Anything that requires a candidate to pay money — registration fees, training fees, deposits, kit charges, or any other payment, at any stage
  • Multi-level marketing, chain-recruitment or commission-only schemes presented as employment
  • An opportunity that discriminates on grounds prohibited by Indian law, including caste, religion, sex, place of birth, or disability. Where a genuine occupational requirement exists, it must be lawful and stated as such
  • Personal contact details of an individual recruiter in the public listing body
  • Duplicate listings for the same role to gain visibility
  • Anything unlawful, misleading or offensive

ProJob may edit, unpublish or remove a listing that breaches this section, and may do so without notice where the breach is serious.

4. Opportunities Posted by ProJob on Your Behalf

ProJob also operates as a recruitment service. Under this model, ProJob's team creates and manages listings on behalf of a client company, sources and screens candidates, and may manage parts of the hiring and workforce process under a separate written agreement.

Where ProJob's team posts an opportunity on your behalf:

  • The listing names your company as the employer, not ProJob
  • You remain the employer for the purpose of these terms, and you remain responsible for the accuracy of the information you give ProJob to publish
  • You authorise ProJob to publish that information and to receive applications on your behalf
  • Listings posted by ProJob's team on your behalf do not consume your self-service posting quota, where you hold a plan
  • The scope of the service, fees, and what ProJob does and does not take responsibility for, are governed by your separate written agreement

Nothing in this section makes ProJob the employer of any candidate.

5. Applications

Applications you receive through ProJob are for the purpose of considering that candidate for the opportunity they applied to.

You agree to handle applications in a reasonable time and to keep candidates informed of the outcome where you can. This is not a legal obligation we can enforce for the candidate, but it is what ProJob expects of employers on the platform, and a pattern of ignoring it may affect your account.

6. Candidate Data — What You May Do With It

This section is the core of these terms. Read it.

Candidate data reaches you in one of two ways: through the candidate database, where your plan gives you access, or through an application a candidate has sent to your opportunity.

You may use candidate data solely to assess and contact that candidate about a genuine opportunity at your own company, and to keep your own recruitment records for as long as you lawfully need them.

You may not:

  • Sell, licence, rent, share or otherwise pass candidate data to any third party, including a group company, a client of yours, or another recruiter
  • Use it to build, add to or enrich any other database, product or mailing list
  • Copy, scrape, harvest or bulk-export candidate data, whether manually or by automated means. This includes tooling that reads pages faster than a person could, and any attempt to work around access limits
  • Contact a candidate for anything other than a genuine opportunity — no marketing, no products, no services, no unrelated offers
  • Contact a candidate who has set their profile to not be discoverable, other than about an application they sent you
  • Retain candidate data after your plan ends, beyond what you lawfully need for a specific candidate you actually engaged with

ProJob monitors access patterns. Bulk retrieval, automated access, and access volumes inconsistent with genuine recruitment will result in access being suspended. We may pursue recovery of losses caused by a breach of this section.

You are independently responsible for complying with Indian data-protection law in respect of candidate data you hold.

7. Contact Details and Access Limits

A candidate being visible to you in search does not mean their phone number and email address are available to you. Contact details are released through ProJob's controlled process, subject to your plan's entitlements, and are recorded.

Entitlements, quotas and limits are set by your plan and are enforced by ProJob. Attempting to work around them — through multiple accounts, shared credentials, or automated access — is a breach of these terms.

8. Your Public Company Profile

Information you provide for your company profile — name, logo, industry, website, about text, public location, size — is displayed publicly on ProJob and may be indexed by search engines.

Your private contact details — company email address and company phone number — are not published on your public profile.

You confirm you have the right to use any logo or brand material you upload.

9. Things You Must Not Do

  • Post anything prohibited by Section 3
  • Breach Section 6 in any respect
  • Misrepresent your company, your authority, or your relationship with a company you post for
  • Ask a candidate for money, bank details, original documents, or any payment at any stage
  • Ask a candidate for information you do not lawfully need
  • Interfere with the platform, or attempt to access parts of it you are not authorised to reach
  • Use ProJob to advertise a competing service to candidates or employers
  • Harass or abuse candidates or ProJob staff

10. Suspension and Termination

We may restrict, suspend or terminate an employer account that breaches these terms. Where the circumstances allow, we will tell you what the problem is first. Where the breach involves candidate data, fraudulent listings, or a payment demand made to a candidate, we may suspend immediately and without notice.

Suspension for breach does not entitle you to a refund of fees already paid.

You may close your account at any time. Closing your account does not end obligations under Section 6 in respect of candidate data you already hold.

11. Plans, Fees and Invoices

Plans, entitlements and prices are as shown at the time of purchase. ProJob may change plan pricing and entitlements for future purchases; a change does not alter a plan you have already bought for its current term.

Fees are payable in advance unless agreed otherwise in writing. Taxes are charged as applicable. [[GST_NUMBER]]

Unused entitlements do not carry forward beyond the plan term unless the plan says so.

12. Refunds

Refunds are governed by ProJob's Refund and Cancellation Policy, which forms part of these terms.

[[OWNER — CONFIRM: does the existing Refund Policy actually cover employer plans? The guide says not to ship a pointer to a policy that is silent on the subject. If it does not cover them, this section needs its own text.]]

13. Our Responsibility

ProJob provides the platform as it is. We do not promise uninterrupted availability, a particular volume of candidates, a particular quality of applicant, or that any hire will result.

Candidate-supplied information comes from candidates. ProJob does not independently verify every candidate's stated education, experience or documents, and you remain responsible for your own verification and background checks before making a hire.

To the extent Indian law allows, ProJob's total liability arising out of your use of the platform is limited to the fees you paid ProJob in the twelve months before the claim arose. Nothing limits liability that cannot lawfully be limited.

14. Indemnity

You will indemnify ProJob against claims, losses and costs arising from your breach of these terms, from a listing you provided or authorised, from your handling of candidate data, or from your conduct towards a candidate.

15. Changes to These Terms

We may update these terms. The date at the top shows when they last changed. Material changes affecting employer accounts will be notified through the platform or by email before taking effect.

16. Grievances, Governing Law and Contact

Grievance Officer: [[GRIEVANCE_OFFICER_NAME]]

Email: [[GRIEVANCE_OFFICER_EMAIL]]

Address: [[REGISTERED_ADDRESS]]

These terms are governed by the laws of India. The courts at [[JURISDICTION_CITY]] have jurisdiction.
